Palestine Action has been added to Schedule 2 to the Terrorism Act 2000 – what will Jersey do?
07/07/2025
Palestine Action was banned as a terrorist organisation after losing a late legal challenge. The protest group is now on the list of proscribed terrorist groups, making membership of, or support for, it a criminal offence punishable by up to 14 years in prison in the UK and 10 years in JERSEY.
The Terrorism (Jersey) Law 2002 outlines several key offences and their corresponding penalties. Here are some of the main offences and their potential jail sentences:
- Membership of a Proscribed Organisation: Being a member of, or professing to be a member of, a proscribed terrorist organisation can result in imprisonment for up to 10 years.
- Support for a Proscribed Organisation: Providing support to a proscribed organisation, including arranging or managing meetings, can result in a prison sentence of up to 10 years.
- Use and Possession of Property for Terrorist Purposes: Using or possessing property for terrorism can lead to imprisonment for up to 14 years.
- Dealing with Terrorist Property: Dealing with property intended for use in terrorism can result in a prison sentence of up to 14 years.
- Failure to Disclose Information: Failing to disclose information about terrorist activities to the authorities can result in imprisonment for up to 5 years.
As outlined in the EXPLANATORY MEMORANDUM TO THE TERRORISM ACT 2000 (PROSCRIBED ORGANISATIONS) (AMENDMENT) ORDER 2025 2025 No. 803 –
- This order https://www.legislation.gov.uk/uksi/2025/803/pdfs/uksiem_20250803_en_001.pdf
- This Order adds “PALESTINE ACTION”, “MANIACS MURDER CULT” AND “RUSSIAN IMPERIAL MOVEMENT”, including relevant aliases, to the list of proscribed organisations in Schedule 2 to the Terrorism Act 2000 (“the Act”). https://www.legislation.gov.uk/ukpga/2000/11/schedule/2
- Organisations listed in that schedule are proscribed for the Act. Any organisation operating under the same name as a listed organisation is also proscribed unless there is a note to the contrary, as there is for Palestine Action. The listing of Palestine Action refers only to the organisation based in the United Kingdom.
Jersey?
Jersey does not automatically adopt updates and additions to Schedule 2 of the Terrorism Act 2000 from the UK. Any changes or updates to this law would need to be made through Jersey's legislative process.
However, Jersey adopts the UK law as follows:
