Mat says:- Positioning Jersey as a Global Hub for Digital Assets

Following my invitation to join a Key Regulatory Panel at Digital Asset Summit 2025 (https://www.hnwadvisorevents.com/digitalassetsummit), I thought I would start thinking about what may be discussed.

The Digital Asset Summit 2025, taking place on October 2nd in Jersey, provides a critical platform to debate and shape this vision.

Opportunity for Jersey

  • With regulators in the UK and US converging on digital asset rules, Jersey has a unique opportunity to position itself as a bridge for global alignment.
  • By acting swiftly to modernise its regulatory frameworks, Jersey can foster innovation while ensuring compliance with international standards.

The Need for Legal Clarity

Markets urgently require a robust legal foundation to provide certainty for digital assets in courts and financial systems.

Jersey can address this by:

  • Establishing Clear Definitions: Define digital assets (e.g., cryptocurrencies, tokenised securities, stablecoins) in law to ensure enforceability and investor confidence.
  • Streamlining Licensing: Create a flexible yet stringent licensing regime for digital asset businesses, balancing innovation with consumer protection.
  • Court Recognition: Develop legal precedents or frameworks for smart contracts and blockchain-based transactions to ensure judicial clarity.

Proposed Regulatory Framework

The Government of Jersey, in collaboration with the Jersey Financial Services Commission (JFSC), should:

  1. Adopt a Principles-Based Approach: Align with international standards (e.g., FATF, IOSCO) while allowing room for innovation.
  2. Create a Digital Asset Sandbox: Enable startups to test new technologies under regulatory oversight, mirroring successful models like the UK’s FCA sandbox.
  3. Enhance Cross-Border Collaboration: Partner with regulators in the UK, US, and EU to harmonise rules, positioning Jersey as a trusted intermediary.
  4. Strengthen AML/CFT/CPF Measures: Implement robust anti-financial crime controls to maintain global trust.

Jersey as a Safe Haven

  • By prioritising clarity, convergence, and collaboration, Jersey can become the "safe place" for digital assets, a jurisdiction where businesses thrive, investors feel secure, and regulators trust the framework.
  • This will attract crypto exchanges, token issuers, and blockchain innovators to Jersey, thereby boosting its economy and enhancing its global reputation.

  • The Digital Asset Summit 2025 is the ideal forum for debating these proposals and charting the path forward.
  • Let’s work together to make Jersey the trusted hub for crypto’s future, built on a foundation of regulatory excellence and global alignment.
