Fraudulent conversion judgment in Jersey; In November last year, Ian Jones successfully argued after two weeks of evidence that the case against his client should be dismissed on the basis there was no case to answer.  On 1 June 2020, the Court of Appeal confirms the position at law that an individual cannot convert their “own property”.

At first instance, the Deputy Bailiff granted that application; and the Attorney General referred the matter to the Court of Appeal.

Finding against the Attorney General, the Court confirmed that:

  • an individual could not convert their “own property” as a matter of law; and
  • the Deputy Bailiff was correct to dismiss the case.
